1. Introduction
Welcome to EditBook.ai, a service operated by EditBook.ai (a trade name of Emendara) (“EditBook.ai”, “we”, or “our”). These Terms and Conditions (“Terms”) govern your use of the EditBook.ai platform and related services. By creating an account or using the Service, you agree to these Terms. EditBook.ai provides AI-assisted tools for editing, translation, generation, and analysis of digital content. Your privacy is governed by our Privacy Policy.
2. Definitions
- Service
- The EditBook.ai online platform that allows Users to upload, edit, analyse, translate, or generate digital content using artificial intelligence.
- User
- Any individual or organisation that creates an account or uses the Service.
- Project
- A workspace where a User manages and processes one coherent work or creative production.
- Organization Account
- An account representing a company, institution, or team.
- AI Provider
- A third-party infrastructure or model provider (e.g., Google Cloud) engaged by EditBook.ai to deliver the Service.
- Wallet balance
- The prepaid funds (denominated in EUR or USD, depending on the User's billing country) Users add via Stripe to run tasks on the platform.
- Agreement
- The legal relationship between the User and EditBook.ai governed by these Terms.
3. Applicability and language
- These Terms apply to all use of the Service worldwide.
- Changes: EditBook.ai may update these Terms. If changes materially affect your rights or obligations, we will notify you in advance (e.g., via email). If you do not agree, you may stop using the Service. Consumers may request a refund of unused paid Wallet balance purchased before the change takes effect, within a reasonable period stated in the notice.
- These Terms are available in English and Dutch. The English version is binding for international and business users. For Dutch consumers, the Dutch text prevails in case of inconsistencies.
4. The Service
- EditBook.ai provides an online platform for AI-assisted editing, translation, image generation, and other content-related tasks.
- The Service may be improved, modified, or extended at any time.
- Substantial changes that materially reduce core functionality for consumers will be announced in advance.
- Data Processing Location: By default, data may be processed globally to provide access to the broadest range of AI models. Users may opt for strict EU-only processing settings, which may limit model availability.
- Temporary service interruptions may occur for maintenance or updates.
5. Use of the Service
Users are responsible for all activity under their account. Each Project may contain only one coherent work (e.g., one book, article, or production). Users may not upload or generate content that:
- violates laws or third-party rights,
- contains discriminatory, pornographic, or unlawful material, or
- infringes intellectual property rights.
AI Providers may refuse to process certain content. EditBook.ai is not liable for such refusals. Users are responsible for safeguarding their account credentials.
6. Accounts and security
- Each User must register a personal account.
- Organisations may register an Organization Account and add authorised users.
- Two-factor authentication (2FA) is available for enhanced security.
- Users are responsible for keeping login details secure.
- EditBook.ai may suspend or terminate accounts in cases of misuse or security risk.
7. Payments and Wallet Funds
- Payments are processed securely via Stripe.
- Wallet Top-up: Users purchase prepaid credits to add to their wallet balance. Actual monetary payment occurs at the moment of this purchase.
- Variable Credit Usage: Credit consumption is calculated based on usage volume (e.g., per AI token). The estimated credit cost for the selected model is displayed prior to starting a task.
- Final Deduction: Since the length of AI generation and processing (input/output) varies, the exact total credit deduction for a task cannot be determined until completion. Any estimates shown are indicative only. By proceeding, you agree to the applicable credit rate.
- Rate Changes: EditBook.ai continuously adds new AI models and features. We reserve the right to update unit rates or introduce new pricing tiers without prior notice, provided the current rate is visible in the interface at the moment of use.
- Validity Period: Credits are valid for twenty-four (24) months. Unused credits expire after this period. Users are sent a notification at least three (3) months in advance when their credits are about to expire.
- EU Consumer Right of Withdrawal: Consumers in the EU have a 14-day right of withdrawal for the purchase of credits. However, by using credits to perform a task, you acknowledge that you lose your right of withdrawal for the consumed portion. Unused credits remain refundable within the 14-day period.
- Wallet funds are non-refundable, except where legally required or in the event of permanent service discontinuation.
8. Intellectual Property
- The platform, software, and brand EditBook.ai remain the property of EditBook.ai or its licensors.
- Users retain ownership of all content they upload or generate.
- EditBook.ai does not claim rights over AI-generated output; Users retain rights to the extent such rights arise under applicable law.
- Users grant EditBook.ai a limited, non-exclusive licence to process uploaded content solely to provide the Service.
9. Data Protection and Privacy
- EditBook.ai processes data in compliance with the General Data Protection Regulation (GDPR) and Dutch privacy laws.
- Details of processing are described in the Privacy Policy.
- International Transfers: Depending on the User's choice of AI models, data may be processed outside the European Economic Area (EEA), specifically in the United States. Such transfers are protected by appropriate safeguards, such as the EU-US Data Privacy Framework or Standard Contractual Clauses (SCCs).
- EU-Only Option: Users have the option to configure their project settings for strict processing within the EEA. In such cases, data does not leave the EEA for AI processing or storage.
- Our network and security provider, Cloudflare, operates a global infrastructure under a GDPR-compliant Data Processing Addendum.
- Data are encrypted in transit and at rest, and never used for AI-model training.
- Users may delete manuscripts or their accounts at any time. Deleted data are removed immediately from the active environment; backup copies are overwritten or destroyed within 30 days.
10. Data Processing Agreement (for Organisations)
- If a User acts on behalf of a business or institution and processes data of others, that User is a data controller, and EditBook.ai is a data processor under the GDPR.
- Such processing is governed by the EditBook.ai Data Processing Agreement (DPA).
- The DPA becomes legally binding when the organisation’s administrator accepts it in the Organization Settings interface.
- Acceptance is logged (timestamp, user ID, version) as proof under Article 28(9) GDPR.
- Individual (consumer) accounts are not subject to the DPA; their data are governed solely by the Privacy Policy.
11. Liability and AI Disclaimer
- Nature of AI: The Service uses probabilistic artificial intelligence. EditBook.ai does not guarantee the accuracy, quality, or suitability of the generated output. AI may produce "hallucinations," factual errors, or stylistic inconsistencies. The User remains solely responsible for reviewing and editing the final content. Such quality issues do not constitute a "lack of conformity" of the Service.
- Service Availability: We strive for high uptime, but the Service depends on third-party API providers (e.g., OpenAI, Google). Temporary interruptions caused by these providers or maintenance do not constitute a material breach of agreement.
- Data Loss: While EditBook.ai maintains encrypted backups of all user data in multiple locations, and strives to ensure data integrity, EditBook.ai is not liable for any loss, corruption, or unavailability of data. Users are solely responsible for maintaining external backups.
- EditBook.ai is not liable for indirect or consequential damages, except in cases of intent or gross negligence by EditBook.ai management.
- To the extent permitted by law, EditBook.ai’s liability is limited to the amount paid by the User for the relevant service in the 12 months preceding the event.
- EU Consumers: Statutory rights regarding material non-conformity (e.g., if the platform is completely inaccessible for a prolonged period) remain unaffected.
12. Termination, Deletion, and Service Discontinuation
- Users may delete manuscripts or terminate their account at any time.
- Deleted data are removed immediately from the active environment; backup copies are destroyed within 30 days.
- EditBook.ai may terminate accounts immediately in cases of misuse, legal risk, or breaches of these Terms.
- Inactive Accounts: EditBook.ai reserves the right to close accounts that have been inactive (no login) for a continuous period of 24 months. We will notify you at least 30 days in advance. Upon closure, all account data will be permanently deleted. Any remaining paid Wallet balance will remain claimable for a period of 3 months after the closure notification, after which it will expire.
- Service Discontinuation (Sunset Clause): In the event that EditBook.ai decides to permanently discontinue the Service, Users will be notified at least 30 days in advance. Users will have the opportunity to use their remaining Wallet balance during this notice period. If the Service is shut down entirely, Users may request a refund of their unused, paid Wallet balance within a claim period specified in the notice, which will be no shorter than three (3) months.
13. Governing Law and Disputes
- These Terms are governed by Dutch law.
- For business users, disputes shall be submitted to the competent court in Amsterdam, the Netherlands.
- For consumers residing in the EU, this forum choice does not affect their right to bring disputes before the court of their own place of residence.
- If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

These Terms are available in English and Dutch. The English version is binding for international and business users. For Dutch consumers who accepted the Dutch version, that version prevails in case of discrepancies.
